- 1. General Provisions
- 1.1. These Terms and Conditions govern all projects related to landscape design, garden creation, and maintenance services provided by our company.
- 1.2. By signing a contract or agreement with us, the client confirms that they have reviewed and accepted these terms.
- 1.3. The company reserves the right to update or amend these Terms and Conditions at any time, with prior notice provided for any significant changes.
- 1.4. Our services are offered in compliance with Egyptian environmental laws and regulations.
- 2. Scope of Services
- 2.1. The company provides a range of services, including:
- Landscape design consultation and planning
- Installation of gardens, lawns, and other outdoor features
- Ongoing garden maintenance and care
- Irrigation system design and installation
- Hardscape construction (e.g., patios, pathways)
- Planting and soil improvement
- 2.2. Specific services and project details will be outlined in a formal agreement with the client.
- 2.3. Any additional services requested outside the agreed-upon scope will be subject to additional charges.
- 3. Consultations and Proposals
- 3.1. Initial consultations may include site assessments and design discussions to determine the client’s preferences and project feasibility.
- 3.2. The company will provide design concepts or proposals tailored to the client’s requirements.
- 3.3. All design proposals remain the intellectual property of the company until full payment is received.
- 3.4. Any significant changes to the approved design requested by the client may incur additional fees.
- 4. Fees, Payments, and Deposits
- 4.1. Service fees are determined based on the scope, complexity, and size of the project.
- 4.2. A deposit of 50% of the total project cost is required upon signing the contract. Work will not commence until the deposit is received.
- 4.3. The remaining balance must be paid upon project completion unless otherwise agreed in writing.
- 4.4. Payments can be made via bank transfer, credit card, or other approved methods.
- 4.5. Late payments may result in additional fees or suspension of services until payment is received.
- 5. Project Timelines and Execution
- 5.1. Project timelines are estimates based on normal working conditions and material availability.
- 5.2. Delays caused by unforeseen circumstances, including adverse weather, supplier issues, or client changes, are not the responsibility of the company.
- 5.3. The client must provide access to the site as agreed upon in the project schedule. Failure to do so may result in delays or additional charges.
- 5.4. The company will ensure that all work is performed to professional standards and will strive to meet client expectations.
- 6. Materials and Plants
- 6.1. The company sources high-quality plants, soil, and materials for all projects.
- 6.2. Clients will be informed of any plant species or materials that may not be readily available and offered suitable alternatives.
- 6.3. The company does not guarantee the survival of plants after installation unless maintenance services are included in the contract.
- 6.4. Irrigation systems or other necessary installations will be recommended to ensure plant longevity.
- 7. Maintenance and Warranties
- 7.1. Maintenance services, if included, will be outlined in the agreement. Maintenance typically covers tasks such as pruning, weeding, watering, and pest control.
- 7.2. The company offers a limited warranty on plants and installations under specific conditions, such as proper care and use of irrigation systems.
- 7.3. The warranty does not cover damages caused by extreme weather, negligence, or unauthorized modifications by the client.
- 8. Client Responsibilities
- 8.1. The client is responsible for providing accurate information about the site and any specific requirements.
- 8.2. Clients must notify the company of any underground utilities, restrictions, or potential hazards on the site.
- 8.3. The client must comply with payment schedules and provide access to the site as agreed.
- 8.4. Any disputes or concerns regarding the project should be communicated promptly to the company for resolution.
- 9. Limitation of Liability
- 9.1. The company is not liable for damages or losses caused by factors beyond its control, including natural disasters or unforeseen site conditions.
- 9.2. The client assumes responsibility for ensuring the safety of the site once the project is completed.
- 9.3. The company is not responsible for damages to underground utilities or pre-existing site features unless explicitly noted in the agreement.
- 10. Cancellation and Refunds
- 10.1. The client may cancel the contract before work begins, subject to a cancellation fee of 20% of the total project cost.
- 10.2. Deposits are non-refundable once materials have been purchased or work has commenced.
- 10.3. The company reserves the right to cancel the contract in case of non-payment or repeated breaches of these terms by the client.
- 10.4. In case of cancellation by the company, the client will be refunded for services not yet rendered.
- 11. Privacy and Confidentiality
- 11.1. Personal and project-related information shared by the client will be treated with strict confidentiality.
- 11.2. The company may use project images for promotional purposes unless the client requests otherwise in writing.
- 11.3. No client information will be shared with third parties without prior consent, except as required by law.
- 12. Governing Law and Disputes
- 12.1. These Terms and Conditions are governed by the laws of Egypt.
- 12.2. Any disputes will be resolved through negotiation or mediation.
- 12.3. If disputes cannot be resolved amicably, they will be referred to the courts of Egypt.
